3. Emergency use — important disclaimer
Sideline Safe is an information and organization tool. It helps authorized adults store and quickly reach an athlete's emergency and medical information and coordinate an emergency response. It is NOT a medical device, does not provide medical advice or diagnosis, and is NOT a substitute for professional medical judgment, emergency medical services, or calling 911.
In any emergency, call 911 (or your local emergency number) first. Do not rely on the Services, on text-message alerts, or on the availability of any information within the Services as your emergency response. Alerts and features depend on internet connectivity, mobile-carrier delivery, device availability, and information being entered accurately and kept current by users; we do not guarantee that any message will be delivered, delivered on time, or received. You are responsible for maintaining your own emergency action plan.
1. Agreement to these terms
These Terms & Conditions (the “Terms”) govern your access to and use of Sideline Safe, including our websites, applications, and related services (the “Services”), provided by SidelineSafe LLC (“Sideline Safe,” “we,” “us,” or “our”). By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Who may use the Services
The Services are intended for adults — parents or guardians, coaches, and school or organization administrators. You must be at least 18 years old to create an account. Athletes do not create accounts or use the Services directly. By using the Services on behalf of a school, club, team, or organization, you represent that you are authorized to do so and to bind that entity to these Terms.

4. Accounts and security
You are responsible for the information you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate information and to keep athlete and contact information — including phone numbers and medical details — accurate and up to date. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to athletes or other users.
5. SMS / text message program
The Services include an optional SMS text-message program that sends emergency and safety alerts to adults who opt in — coaches, athletic staff, administrators, and designated emergency contacts. You opt in by entering your mobile number in the Services and agreeing to receive emergency text alerts. When a medical or safety emergency is declared for an athlete, opted-in recipients receive a text about the active emergency and a link to the relevant information in the app.
Message frequency varies and depends on emergency activity. Message and data rates may apply. Reply STOP at any time to opt out of further texts; reply HELP for assistance. We do not share mobile phone numbers with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details on how mobile information is handled. Consent to receive texts is not a condition of using the rest of the Services.
6. Acceptable use
You agree not to misuse the Services, including by: accessing information you are not authorized to access; declaring a false emergency or using the emergency features other than for a genuine emergency; uploading unlawful, infringing, or harmful content; attempting to disrupt, reverse-engineer, or gain unauthorized access to the Services; or using the Services to violate any law or the privacy or rights of others. The emergency medical-record gate and access logs exist to protect athletes; circumventing or misusing them is a violation of these Terms.
7. Your content and data
You retain your rights in the information and content you submit. You grant us a limited license to host, store, process, and transmit that information solely to operate and provide the Services as described in these Terms and our Privacy Policy. For information provided through a school or organization, that entity controls the data and our handling of it is also governed by our agreement with them.
8. Intellectual property
The Services, including their software, design, text, and branding, are owned by Sideline Safe or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Services except as expressly permitted.
9. Third-party services
The Services rely on third-party providers for hosting, storage, email, and message delivery. We are not responsible for the availability, performance, or acts or omissions of third-party networks or carriers, including any failure or delay in delivering a text message or email.
10. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any alert or information will be delivered or available when needed. Your use of the Services is at your own risk.
11. Limitation of liability
To the fullest extent permitted by law, Sideline Safe and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of or relating to your use of, or inability to use, the Services — including any injury, harm, delayed or undelivered alert, or reliance on information in the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the claim, or one hundred dollars ($100) if you paid nothing. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Sideline Safe from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your content, or your violation of these Terms or of any law or the rights of others.
13. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or to protect the Services or their users. Provisions that by their nature should survive termination — including intellectual-property, disclaimer, limitation-of-liability, and indemnification provisions — will survive.
14. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Georgia for any dispute not subject to arbitration or small-claims resolution, to the extent permitted by law.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post notice on our website and may notify account holders by email before the change takes effect. Your continued use of the Services after the changes take effect means you accept the updated Terms.
